IMPORTANT: BIR Arbitration Service to be terminated as of 1 January 2024

  • 10 July 2023

Dear BIR Member,

A revision of the BIR Articles of Association was adopted at the last BIR General Assembly in Amsterdam on 23 May 2023. Among the many amendments, the BIR General Assembly decided that the BIR Arbitration Service will be terminated as of 1 January 2024.

Since BIR will no longer be able to accept requests for arbitration after that date, we recommend that our members remove any BIR Arbitration clauses from their business contracts. As of 1 January 2024, any existing or new contracts should no longer contain a BIR Arbitration clause, nor should BIR arbitration be agreed otherwise.

While BIR will no longer offer a formal dispute resolution process to its members, it will continue to offer informal assistance to help resolve any disputes between them and find an amicable settlement. BIR’s aim remains to promote a collaborative approach, encouraging communication and mutual agreement between parties.

We appreciate your attention to this matter. Thank you for your understanding and cooperation.

Yours sincerely,

Arnaud Brunet
BIR Director General
